FYI - As the Arbitration Committee Chair, and in concert with Fred, I have sent our CLASI lawyers copies of last years notice of rate increase effective Feb 01 2025 (where RHP advised they might be charging us an adjustment for property tax increases) and this years notice of rate increase effective Feb 01 2026 so they can review all and advise us of our options.  Stay tuned!

To my Wild Meadows neighbors,

 

The RHP required Annual rent increase notices for February 1, 2026 have arrived. With it, I have received a flurry of questions.

 

Wild Meadows has 2 types of leases. One is long term lease at 4%, which I understand RHP may be blocking the transfer of those leases when the house is sold. Anyone who was entitled to the transfer of that type a lease, who did not receive the transfer must file a complaint via the Ombudsman for the Dept of Justice, Deputy Attorney General Brian Eng.

 

Most of us have the Annual lease. Anyone who was entitled to the transfer of the Annual lease, who did not receive the transfer must file a complaint via the Ombudsman for the Dept of Justice, Brian Eng. The Annual leases have several increase options for the Annual increase listed in Code 25, of Chapter 70.

 

This year, for the Annual Rent increase RHP has opted for the guaranteed Annual increase of 3.5% + ½ of the CPI-U. In addition, RHP added a Property Tax increase caused by the Voters approved huge jump in the School tax that is collected by Kent County. Dover City Property taxes are tiny. We pay both of the taxes on our homes.

 

If you read Code 25 which you received when you signed your lease, you will see that RHP can raise your rents to cover their cost of the property tax. BUT, can RHP do so when they opted for the guaranteed increase?

 

Or is some of that additional tax increase covered in part by the guaranteed rent increase option?

 

Or can RHP make that increase a part of rent compounded into a higher rent next year?

 

Before seeing my copy of the rent increase yesterday. I was alerted by a neighbor of the added tax request. I immediately sent an email asking those questions to our CLASI attorneys. I will provide their responses to the HOA, those of you on my email list and with our email newsletter editor, Debbie Geiser as soon as I hear.
